1. Acceptance of Terms

Welcome to Home Comfort Build ("we," "us," "our," or "the Company"). By accessing or using our website at www.homecomfortbuild.com (the "Site") and engaging any of our home renovation, remodeling, or related services (the "Services"), you ("you," "Client," or "user") agree to be bound by these Terms and Conditions ("Terms").

If you do not agree with any part of these Terms, please do not use our Site or Services. These Terms constitute a legally binding agreement between you and Home Comfort Build.

We may revise these Terms at any time. The most current version will always be posted on this page with an updated "Last Updated" date. Your continued use of the Site or Services after changes constitutes acceptance of the revised Terms.

2. Description of Services

Home Comfort Build provides home renovation, remodeling, and property improvement services to residential clients across the United States. Our services include but are not limited to:

3. Quotes & Estimates

All quotes provided by Home Comfort Build are based on information available at the time of estimation, including the client's stated requirements, site conditions, material costs, and labor rates. Quotes are valid for 30 days from the date of issue unless otherwise specified.

Initial estimates may be approximate. A binding fixed-price proposal will be issued following an on-site consultation. Home Comfort Build reserves the right to revise quotes if:

4. Project Contracts

Every renovation project is governed by a written contract that includes the scope of work, project schedule, payment schedule, materials list, warranty terms, and other project-specific provisions. In the event of any conflict between these Terms and a project contract, the project contract shall prevail for that specific project.

The client must sign the contract and pay the required deposit before any work commences or materials are ordered. Work is scheduled only after both requirements are fulfilled.

5. Payment Terms

5.1 Deposit

A non-refundable deposit of 25%–35% of the total contract value is required to secure your project date and order materials. The exact deposit percentage will be specified in your contract.

5.2 Progress Payments

For projects exceeding $10,000, payments are typically structured as follows:

Invoices are due within 7 days of issuance. Late payments may incur a 1.5% monthly finance charge (18% annually). Home Comfort Build reserves the right to pause work on any project with overdue invoices.

5.4 Financing

For clients utilizing our financing partners, all loan terms are governed by the lender's agreement. Home Comfort Build is not a lender and is not responsible for loan approvals, interest rates, or lender decisions.

6. Warranty & Guarantees

Home Comfort Build offers the following warranties on our workmanship:

Warranty claims must be submitted in writing within the warranty period. We will repair or replace defective workmanship at no cost to the client.

7. Change Orders

Any changes to the agreed scope of work must be documented in a written Change Order signed by both the client and a Home Comfort Build representative. Change Orders may affect the project price and timeline. Verbal requests for changes will not be honored unless subsequently documented in writing.

If the client requests additional work not included in the original contract, Home Comfort Build will provide a written estimate for the additional work. Work commences only after the Change Order is signed and any additional deposit is paid.

8. Cancellation & Refunds

8.1 Cancellation by Client

If you cancel your project before work begins, the deposit is non-refundable to cover administrative costs, design work, and materials ordered. If materials have already been ordered, you are responsible for those costs.

If cancellation occurs after work has commenced, you are responsible for all work performed and materials purchased up to the cancellation date, plus a 15% cancellation fee on the remaining contract value.

8.2 Cancellation by Home Comfort Build

We reserve the right to cancel a project if the client breaches the contract, fails to make payments, or engages in abusive or unsafe behavior. In such cases, the client remains responsible for work completed and materials purchased.

8.3 Refund Process

Eligible refunds, if any, will be processed within 30 days of cancellation approval and returned to the original payment method.

All content on this website — including text, graphics, logos, images, designs, 3D renders, and software — is the property of Home Comfort Build or its licensors and is protected by U.S. and international copyright laws.

You may not reproduce, distribute, modify, or republish any content from this site without our prior written consent. Project designs, blueprints, and 3D renders created for a client remain the property of Home Comfort Build until final payment is received, at which point they transfer to the client for personal use only.

11. Limitation of Liability

To the maximum extent permitted by law, Home Comfort Build shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services or website. Our total liability for any claim arising from our Services shall not exceed the amount you paid us for the specific project giving rise to the claim.

We are not responsible for damages caused by pre-existing conditions, hidden defects, or third-party products. We are not liable for delays caused by weather, supply chain disruptions, permit processing times, or events beyond our reasonable control.

12. Indemnification

You agree to indemnify, defend, and hold harmless Home Comfort Build, its officers, employees, agents, and subcontractors from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

13.1 Good Faith Negotiation

Both parties agree to attempt to resolve any dispute through good faith negotiation. The complaining party must provide written notice of the dispute, and the parties will attempt resolution within 30 days.

13.2 Mediation

If negotiation fails, the parties agree to participate in mediation with a neutral mediator in Pickerington, Ohio, before pursuing litigation.

13.3 Arbitration

If mediation fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association in Ohio. The arbitrator's award may be entered in any court of competent jurisdiction.

13.4 Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

You may not assign these Terms or your rights under any project contract without our written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.

15.4 Force Majeure

Home Comfort Build is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, labor disputes, supply chain disruptions, or governmental actions.

Our failure to enforce any provision of these Terms shall not be considered a waiver of our right to enforce it later.
